[3]Herbers had sent Einstein a circular, asking him to be deposed in his appeal against his convic- tion for allegedly inciting Reichswehr soldiers to disobedience through a notice in Das Andere Deutschland, the organ of the radical wing of the Deutsche Friedensgesellschaft. The notice, which had appeared in May 1926, had called on soldiers to defy the ban by the German defense minister Otto Geßler on viewing the pacifist film Battleship Potemkin. Hebers had been sentenced to a fine of 200 marks in late January (see Abs. 771, Das Andere Deutschland, 15 May 1926 and 29 January 1927, and Lütgemeier-Davin 1988, pp. 86–90). 490.
